In the comments section, though, Professor Michael Froomkin (the founder of the terrific JOTWELL...seriously, check it out if you haven't already), posed a trickier question:  A hard question for me is a student who doesn't know the meaning of somewhat but not utterly common non-legal word that I happen to use in a question, a dictionary word that is not a legal term, guesses wrong, and thus writes an essay that misses the point.
