My thought is that the various Ninth Circuit judges here are each trying to make a point.Judge Bumatay, joined by five other judges, would grant the petition for rehearing en banc, and explain at length (35+ single-spaced pages) why they think the panel got the decision wrong and (perhaps) why the Supreme Court should take the case up and reverse.
