This neglects the concern in Norton v Southern Utah Wilderness Alliance that courts are simply ill-equipped for resolving abstract policy disagreements or constantly overseeing the day-to-day operationalization of compelled agency action.It is also unclear how courts can resolve agency inertia without exacerbating either agency confusion or the lack of political accountability.
