It just seems a stark, very binary sentence.At a minimum, you'd think that someone with such a sentence hanging over his head would work very hard to make sure he didn't reoffend during the three years he was on probation. [read post]

Moreover, the trial judge -- Judge Nancy Stark up in Contra Costa County -- apparently does indeed have the bailiff follow the defendant around wherever he goes (and conspicuously, at that).The analogy to making 'em wear shackles and/or an orange jumpsuit seems pretty strong to me.Do I have a problem with ordering a bailiff to follow around a defendant who's known to be at risk of trying to escape or commit violence? But the stark reality is that we all know that this is not going to happen -- indeed, in the Court of Appeal (as well as below), the Attorney General's office defended what the agents did, arguing that it was entirely permissible for law enforcement agents to secretly listen to privileged attorney-client communications uttered in hushed tones in a private conference room (in Russian, no less).While the Court of Appeal thankfully rejects this position, it's not enough.  [read post]
