In Moorgate Tobacco Ltd v Philip Morris Ltd [1985] RPC 219, the high Court of Australia held at 234 that: 'the equitable jurisdiction to grant relief against an actual or threatened abuse of confidential information does not lie in proprietary right, but in the notion of an obligation of conscience arising from the circumstances in or through which the information was communicated or obtained.'
