In the news report published by Duke University, Robert Cook-Deegan, director of the IGSP Center for Genome Ethics, Law & Policy, is quoted saying that exclusive licenses, and presumably patents, are valuable for developing drugs and biologics that would not otherwise be developed without such protections. In fact, as Robert Cook-Deegan (Duke University) and I explained in an amicus brief we filed with the Federal Circuit, it seems highly unlikely that Myriad’s isolated DNA claims that are the subject of the current appeal would be found valid and infringed by DNA sequencing, in the unlikely event the claims were ever asserted in court. Robert Cook-Deegan and others at the Duke University Center for Genome Ethics (included in an oft-cited Health and Human Services report) found that the BRCA1 and BRCA2 patents had little consistent effect on diagnostic testing prices, which were affected more by insurance and available testing methods. In TC Heartland, the accused infringer has asked the Supreme Court to reset the law of venue and give effect to the statutory statement that infringement actions be brought either (1) “in the judicial district where the defendant resides” or (2)” where the defendant has committed acts of infringement and has a regular and established place of business.
