As I told Scott Flaherty of Law360 yesterday, the way the SCOTUS has framed the issue makes me think they may find in favor of the EEOC: Whether an employer can be liable [for discrimination based on an employee's religious belief or practice] only if the employer has actual knowledge that a religious accommodation was required and the employer’s actual knowledge resulted from direct, explicit notice from the applicant or employee.
