 In Baker v Secretary of State for Communities & Local Government [2008] EWCA Civ 141, Dyson LJ, at paragraph 31, Sir John Dyson emphasised that the section 71(1) duty was not a duty to achieve the result of eliminating racial discrimination as such, or to promote equal opportunity, but a duty to have “due regard” to the need to achieve these goals. Ngnoguem v Milton Keynes Council (2020] EWCA Civ 396 We’ve seen this prefigured in Stanley v Welwyn Hatfield Borough Council (2020) EWCA Civ 1458 (our note), but the relevant parts of that judgment on late reviews were strictly obiter, as the court had found that there was an agreement to extend time. Both are Article 14 discrimination based, with disabilities meaning a bedroom could not be shared, one adult partners and the other a non-dependant requiring overnight care 2 mights a week.There is also an Upper Tribunal decision, LA v Bury Metropolitan Borough Council (HB) [2013] UKUT 546 (AAC).
