The courts are also disinclined to decide Article 14 cases on the basis that the comparators are not in an analogous situation other than in very obvious cases: see R (Carson) v Secretary of State for Work and Pensions [2005] UKHL 37. [read post]

Both are Article 14 discrimination based, with disabilities meaning a bedroom could not be shared, one adult partners and the other a non-dependant requiring overnight care 2 mights a week.There is also an Upper Tribunal decision, LA v Bury Metropolitan Borough Council (HB) [2013] UKUT 546 (AAC). Ngnoguem v Milton Keynes Council (2020] EWCA Civ 396 We’ve seen this prefigured in Stanley v Welwyn Hatfield Borough Council (2020) EWCA Civ 1458 (our note), but the relevant parts of that judgment on late reviews were strictly obiter, as the court had found that there was an agreement to extend time. McKenzie, R (on the application of) v London Borough of Waltham Forest [2009] EWHC 1097 (Admin) was a Judicial Review initially brought on grounds that the local authority refused to provide the claimant with temporary accommodation following her notification by the hostel she was living in that she would not be able to remain once her baby was born.
