The Tenth Circuit held that, whether viewed as compelled speech or as a content-based restriction, the restriction had to – and did – satisfy strict scrutiny: Colorado could show that it has a compelling interest, and that the restriction is narrowly tailored to satisfy that interest (Reed v Town of Gilbert 576 US 155, 164 (2015)).
