These types of case will generally be fact-specific, requiring a careful balancing of competing rights; the Court of Appeal’s decision is certainly not a death knell for “fly on the wall” documentaries, like PJS v News Group Newspapers Ltd (Rev 1) [2016] UKSC 26 was for the “kiss and tell” tabloid stories.
