into a Senate committee Monday after a three-hour debate that left
proponents and opponents of capital punishment unsatisfied. The drama

The Associated Press TOPEKA Legislators have scheduled hearings this
week to review the cost and effectiveness of Kansas' death penalty
law. The Senate Judiciary Committee begins its work Tuesday. A bill
was debated last year that would have prevented new death sentences
after July 1, 2009, but the bill was sent back to committee for more
work. Kansas enacted its death penalty law in 1994, but there have

High Court Sends Back Abu-Jamal Death Penalty
    Case
The Supreme Court on Tuesday threw out a court ruling that invalidated
a former Black Panther's death sentence for killing a Philadelphia
police officer in 1981, one of two rulings it issued that reversed
actions by lower courts. The first move was the latest twist in Mumia
Abu-Jamal's racially tinged case that has drawn international

WHEN WATER IS AS THICK AS BLOOD [FLORIDA]
We all know the expression "blood is thicker than water." Presumably,
that is what a trust settlor had in mind when she made a class gift to
her grandchildren, and included language that such grandchildren would
only include "descendants by blood." The settlor's son married his
wife in 1966. Six months after the marriage, the son and his wife had

As an Aventura wrongful death attorney, I was dismayed to see that a

Anatomy of an Execution -- a Must Read Memoir
    for all Death Penalty Opponents
You have to read this book. That's all I really need to write here,
but it's impossible to stop typing about how David Dow's memoir is so
important for anyone connected with capital punishment to read -- and
why this is so. First, he provides a clear and unique perspective.
David Dow is not only a professor at the University of Houston Law

    Death Penalty?
Before he was governor of the Great State of Kansas, Mark Parkinson
worked in the state senate as a legislator, helping to draft the
current law approving of capital punishment in that state. Kansas'
death penalty statute was passed into law back in 1994. However, it's
a new day and last Friday, another piece of legislation started making
its way through the Kansas legislature -- a law that would repeal the
death penalty, and replace it with a crime of capital murder with

    Assault

    Assault
An "assault,"or "simple assault," is an intentional, unlawful threat
by word or act to do violence to the person of another, coupled with
an apparent ability to do so, and doing some act which creates a
well-founded fear in such other person that such violence is imminent.
Thus, the statute requires proof of three elements: (1) an
    intentional, unlawful threat; (2) an apparent ability to carry it out;
and (3) creation of a well-founded fear that the violence is imminent.

When is a "Partner" really just an
    "Employee?"
Among the most intellectually challenging and unresolved issues facing
employment attorneys is the very basic question of whether a partner
in a business can also be an employee. Over the last several years
many law firms have been sued by "partners" for violating the Age
Discrimination in Employment Act -- even though the plaintiff was a
partner in the firm, i.e., the plaintiff is, at least theoretically,
one of the owners of the business. Generally speaking, the owner of a

A pit bull charged a Broward County Sheriff's deputy and, as a result,

roaming the streets of Fort Lauderdale. When the deputy located the
pit bull it attacked him and he shot it twice. The animal was taken to
Broward County Animal Control where an investigation is ongoing. The

A five (5) year old North Miami girl drowned when her grandmother who
was watching her left her alone. The grandmother decided to go to the
grocery store to do some shopping and allowed the five (5) year old to
stay home without her. When the grandmother returned she found the
child floating in the pool. There was no protective fence surrounding
the pool which more likely than not enabled the child to climb in. The
grandmother is being charged with manslaughter. This is such a sad

    Cat Called to Jury Duty

    Cat Called to Jury Duty
A family in East Boston was shocked when their family cat Sal received
a jury summons recently. Sal's owners, Guy and Anna Esposito, believe
the source of the confusion came from the last Census. Mrs. Esposito
considers Sal a member of the family and listed "Sal Esposito" under a
section for pets and wrote "cat" next to his name. Mrs. Esposito has
since tried to clear the mix-up by filing for Sal's disqualification

    Sinkholes in Bay Area

    Sinkholes in Bay Area
Over 30 sinkholes have recently opened up around Tampa Bay this past
month. Why the sudden increase in sinkholes? We have the cold weather
spell to thank for this rash of sinking. During the recent cold snap,
much of the groundwater below the surface has vanished. The lowered
groundwater levels are due to pumping of water to protect crops from
freezing temperatures. Farmers use water to give their plants a
protective coating, or just to keep them warm during the period of
freezing temperatures. Research Posted on Thursday, February 4, 2010 at 12:45 pm

Not surprisingly, a recent study, done at the University of Utah,
determined that texting while driving, not only increases the risk of
having a car accident, but is significantly more dangerous than
talking on a cell phone while driving. The study determined that
texting drivers were less likely to apply their brakes in a timely
manner to avoid a car accident, that they followed other vehicles too
closely and demonstrated significantly delayed reaction times.

replenish shorelines without compensating any affected private
landowners. Florida's beaches have been replenished with sand for many
years without allowing claims requesting compensation for loss of
