    Odds and Ends

    Odds and Ends
Here are a few recent tidbits that deserve Grits readers' attention:
Dallas constables' ongoing fiasco At the Dallas News, Ed Timms and
Kevin Krause have the story of a deputy constable with a checkered
past accused of committing several felony crimes, including
"unauthorized use of two motor vehicles, tampering with government
records and coercing two women into performing sexual acts instead of
arresting them on outstanding warrants." (UPDATE 2/8: See a followup
story.) Meanwhile his blustering boss Jaime Posted on Monday, February 8, 2010 at 10:53 pm

    Index theft categories to inflation

    Index theft categories to inflation
In 1993, Texas set the current threshold for felony theft at $1,500
for a state jail felony - below that, theft receives misdemeanor
charges that don't involve state prison time. The jump to the next
offense category is quite significant - someone must steal more than
$20,000 to be charged with a third degree felony. However, adjusting
for inflation, $1,500 in 1993 amounts to $2,208 in 2008 dollars.
Indeed, "if you were to buy exactly the same products in 2008 and

    TX polygamist ranch
I said from the get-go that the search warrant used to get on the YFZ
Ranch property in Eldorado back in 2008 was overbroad, based on lies,
and that evidence derived from the Great Eldorado Polygamist Roundup
should be suppressed in criminal court. Now an Arizona judge has
concluded the same thing after prosecutors there tried agreed not to
introduce evidence against polygamist "prophet" Warren Jeffs

    Super Bowl XLIV Primer
Too much is written about the Super Bowl each year, so it is
increasingly difficult to separate the wheat from the chaff. The
following are a few pieces that will provide a good primer for this

Overcriminalization of life and the appalling condition of our
country's prison facilities have been frequent subjects on this blog
over the years. At least one member of the U.S. Supreme Court has
taken notice: U.S. Supreme Court Justice Anthony M. Kennedy criticized
California sentencing policies and crowded prisons Wednesday night,

    More Crashes Adds toToyota's Problems
The trip was one that Guadalupe Alberto had made many times before,
just a few miles through her neighborhood to the small grocery store
her family had owned for years. It was a Saturday afternoon, April
2008, and Mrs. Alberto, a 77-year-old former autoworker, was driving

police, the car accelerated out of control, jumped a curb and flew

A Cincinnati couple has filed a lawsuit against Toyota charging fraud

Relief is Just a Click Away
Texas lawyers have never been stingy when it comes to helping in times
of need. When Hurricane Ike devastated the Texas Coast in 2008, Texas
lawyers came out in droves to help their fellow Texans. Last month's
earthquake in Haiti is no exception. Thousands of Texas attorneys have

The State indicted Oscar Roy Doster for capital murder in Freestone

was in an Alabama prison (no Midnight Special for him). His presence

A unanimous CCA held that a pre-trial habeas corpus proceeding

A recent comment led me to one of my first ever posts, one about the
Gateway Theory of drug use. For those unaware of the fallacy, it goes
like this: many/most/almost all hard drug users started with softer
drugs like marijuana, therefore marijuana causes harder drug use. It
is the gateway to cocaine, heroin, methamphetamines, etc. My post

Yesterday, a horrific tractor-trailer wreck occurred in North Texas
when an eighteen wheeler slammed into the back of traffic stopped on
Interstate 35 near the Texas-Oklahoma border. Tragically, three people
(Anthony and Kimberly Brandon of Bedford, Texas and Darryl Hoosier of
La.) were killed in the wreck. The Brandon's vehicle exploded on

Death of the Estate Tax May Cost Heirs More
Most estate planners never expected Congress to let federal estate tax
expire. And when it did, most expected Congress to quickly enact new
estate tax legislation, possibly making it retroactive to January 1.
As of today, Congress has yet to act, leaving the estate planning
world in a continued state of turmoil. The Death of the Estate Tax
Last year, only estates valued in excess of $3.5 million were subject

    - Age and Maturity
NB: This post is part of a series discussing factors you should

children's guardian, it is important to consider not only that
person's age, but their maturity level. Texas requires that guardians
be at least 18 years of age. But just because a person is legally an
adult does not mean that he or she is ready to take on the

Alimony and spousal maintenance are still alive. In certain situations
spousal maintenance is an option and it may be one of the issues you

situations is if your marriage lasted more than 10 years either spouse

Texas continues her work from the bench, it appears that lots of other

we've got the findings from Judge David Berchelmann for everyone to

When last we wrote about Chief Justice Sharon Keller of the Texas

wrongdoing. That's right - the top judge in the highest criminal court
in this state, on trial. State District Judge David Berchelmann,
setting in Bexar County, Texas, was appointed to hear the evidence and
make findings of fact. These factfindings would then make their way to

Today we will begin a series that a prosecutor friend of mine was kind
enough to provide. From the outset, please understand that these rules
are simply her ideas on the subject and are not intended to apply
globally, but, if you ask me, they probably should. Let's begin with
#10: When a defendant on TV or in a movie settles his criminal case,
we hear that he accepted a "plea bargain." However, most jurisdictions
don't use the term "bargain." Rather, as practitioners of criminal
law, we use "negotiation." Posted on Saturday, February 6, 2010 at 12:12 pm

Sometimes, families facing a divorce have a successful family business

How do I appoint a future guardia ...

How do I appoint a future guardian for my
    children?
In Texas, appointing a guardian for one's children is normally done in
one of two ways: in a person's Will or in a separate Appointment of
Guardian document. While I typically include that information in a
will, I prefer to also appoint guardians using a separate instrument.
The reason that I prefer this approach is that a will does not become

What is the status of the estate tax
    currently?
As of January 1, 2010, the Federal estate tax has been repealed -- but
only for one year. As part of the 2001 tax act, Congress increased the
amount persons could give away tax-free at death (the "Exemption
Amount"),. This amount increased each year over a 10 year period. The
Exemption Amount reached $3,500,000 in 2009 and ultimately became
unlimited this year. In other words, the Exemption Amount in 2010 is
equal to the value of your entire estate. However, tax law changes

I've written several posts on the potential pitfalls that may befall a
company that mistakenly classifies workers as independent contractors.
You can see those posts here and here. A recent bill introduced in
Congress would make it even more difficult to classify workers as

    An Appellate Rewrite
The large part of an appellate lawyer's practice consists of writing.
And one way to improve one's writing is reading. Thus I read lots of

One of the first questions (if not the primary question) that I am

expensive. The expense does not derive from filing fees, transcript
fees, or any other fees, but the preparation needed to skillfully
pursue the appeal. A lawyer, no matter how smart he is, must master

It seems the new DIVERT Program is again changing without a real
reason why. As of last week, the county court prosecutors learned that
the DWI cases that may be DIVERT eligible must now be set up for
DIVERT no later than the second setting. For the record, the first
setting is generally scheduled for 1 week after the arrest. The second

In San Antonio drivers who hit bicyclists or pedestrians are seldom

Sometime shortly, the Senate is expected to vote on the fate of the

Possible Rise in Yuan to Dollar Exchange Rate
The biggest gap in world trade includes the U.S. trade deficit and the
Chinese trade surplus. This gap is driven, in part, by what some claim
is China's pegging of the Yuan at an artificially low rate against the
U.S. dollar in an effort to boost exports. But exports are slowing,
and, in a dramatic departure from previous policy China has indicated
it may allow yuan appreciation against the dollar. The Yuan recently

The debate over health care reform continues to grow, and it appears

hasn't spelled out what he wants in a public plan, despite his strong

    Economic Outlook For 2010?

I'd set out some of the differing statistics that I've found over the
last few weeks and let you decide for yourself whether to believe the
optimists or the naysayers. The Optimists There are many people who
believe that the U.S. economy is likely to improve in 2010. The
statistics supporting even a moderate recovery include the following:

Federal Court Refuses to Shift Cost of OCR
The Delaware Corporate and Commercial Litigation Blog recently
discussed a decision out of the Eastern District of Texas. In Proctor
& Gamble Co. v. S.C. Johnson & Son, Inc., the Court refused to
shift the costs involved to OCR the defendant's production of
documents. The Court found that cost shifting was inappropriate in
this case because the defendant failed to show the documents were
obtainable from other sources, had adequate financial resources

In Superior Production Partnership v. Gordon Auto Body Parts Co. (S.D.
Ohio 2009) the Court ruled that sanctions were not appropriate absent
evidence that any relevant information had been destroyed. The case
involved predatory pricing and Superior Production d/b/a PBSI brought
a motion for sanctions based upon the defendants failure to institute
a legal hold and failure to conduct a thorough search for relevant
information. The Defendants had not instituted a formal legal hold and

Buying a Business in Texas Step #3: Time to
    Close
After completing the due diligence process, a buyer will have enough
information to make a final decision upon closing the transaction. Â
The Letter of Intent will have laid out the basic process for closing
the purchase or sale of the business, but what exactly is involved in
closing the transaction? As lawyer's often state, it depends. Â It
depends on what was discovered during the due diligence process. Â
The LOI will have laid out the basics such as the consideration for
the purchase(cash, stock, etc.), Posted on Friday, October 30, 2009 at 3:30 pm
