On November 22, 2023, the Departments used their statutory authority (Internal Revenue Code Section 9816(c)(9), ERISA Section 716(c)(9), and PHS Act Section 2799A-1(c)(9)) to grant extensions in the following circumstances: Disputing parties may request additional time, beyond the current business day deadline, to respond to the certified IDR entity’s requests for additional information.
