The ADA generally does not cover FHA dwellings, which includes the common areas of an apartment complex, but “certain portions of a residential building may be covered by the ADA if ‘made available to the general public for rental or use.'” Because FHA liability for design/build flaws rests only with the original owner, finding ADA access barrier removal liability (which applies to all owners) is often important to plaintiffs.
