Elias LJ assessed the fees scheme not simply against the ECHR by also against the International Covenant on Economic Social and Cultural Rights (ICESCR) on the basis that the Court of Human Rights has, in recent cases, considered ECHR rights in light of the provisions of the Covenant (see Demir & Baykara v Turkey (2009) at [85] and Opuz v Turkey (2010) at [185]).
