I think if there was anything that might be said to be novel about the decision, it is really applying an approach which has been common in other areas of law, for example tax law, but maybe hasn’t been fully recognised in the field of employment law, that, where legislation has a clear purpose, it ought to be interpreted and applied, so far as it can be, in a way that gives effect to that purpose.
