Reversing an appellate court’s dismissal of the employee’s claims on summary judgment, the New York Court of Appeals ruled that the employee was not required to identify — in her pleadings — the specific “law, rule or regulation” allegedly violated by the employer in order to state a plausible claim (Webb-Weber v Community Action for Human Services, Inc, May 13, 2014, Pigott, J).  In answering the question whether Welwyn had reasonably applied its special urgency procedure (presumably to ward off the vampiric Vanhegan), Jay J held that this was not the exercise of a draconian power like HMO enforcement (Webb v Wandsworth LBC (1989) 21 HLR 325); it was simply an inconvenient minor procedural error to fail to convene a Cabinet meeting on 31 March 2010 “which scarcely impacted on the substance of the matter”.
