Reviewing the relevant cases that preceded Seattle, specifically Hunter and Reitman v Mulkey (387 U.S. 369, 1967), the plurality opinion explained that those cases involved demonstrated injuries on the basis of race that, by reasons of state encouragement or participation, became more aggravated.
