According to Tel Aviv University law professor Aeyal Gross, “a finding that [the ICC] does not have jurisdiction if the relevant state has investigated a matter itself” would not be relevant in the case of settlements because the settlements are a “government policy...the establishment of the settlements was based on cabinet decisions and with Israeli government funding.
