This Kat was perusing the excellent IPDraughts blog the other day, and read this report of an interesting case Wright Hassall LLP v Horton Jr & Anor [2015] EWHC 3716 (QB), which is a bit of an oddity - it is basically a solicitor negligence case, brought about by the solicitor claiming for unpaid fees, and the client counterclaiming for negligence. A 2010 case out of New York illustrates that an assignment of litigation rights may or may not constitute champerty depending on the intent of the parties to the assignment agreement - at least in cases where the assignment is to attorneys who are bringing the lawsuit on behalf of the assignor.
