As regards the issue of costs, in the Milan case, the reasoning (albeit in the context of interim proceedings) appears substantially similar with the most recent approach in the UK, as envisaged by the Supreme Court in Cartier [here]. [read post]

The Supreme Court has handed down a decision in the Cartier case finding that internet service providers (“ISP’s”) do not have to bear the costs of implementing a blocking injunction pursuant to section 37(1) of the Senior Courts Act 1981, the statue requires ISP’s to block access to sites which sell goods that infringe upon trade mark rights.
