The ultimate test, as those same cases explain, is whether the evidence tends to undermine confidence in the outcome of the trial, whether there's a "reasonable probability" that the outcome would have been different had the evidence been used at trial.I was in the Ohio Supreme Court years ago waiting to argue my case while Cathy Cook was arguing a death penalty appeal.
