Court of Appeals unanimously ruled that there is sufficient reason to allow a jury to consider whether "Somebody to Love," a 2010 chart-topper from usher and Bieber, bears too much resemblance to an earlier song of the same name recorded by two Virginia musicians, Devin Copeland and Mareio Overton. Hip hop artist Devin "the Dude" Copeland saw his copyright claim against Usher and Justin Bieber resurrected last week as Circuit Judge Pamela Harris of the Court of Appeals for the Fourth Circuit vacated the district court's earlier ruling that "Somebody to Love" did not infringe Copeland's copyright in his own song of the same name.
