And when it does, circa 2012, I imagine that the Court will strike down Prop 8 and other anti-gay marriage laws by deciding that the rational-basis test does not apply to laws discriminating against homosexuals, and that the appropriate test under the Equal Protection Clause is "intermediate scrutiny," and Prop 8 will not survive that new test.
