The Conroe Courier yesterday had the story of a new mental health docket in Montgomery County (using "managed assigned counsel," whatever that means) created with a grant from the Texas Indigent Defense Commission aimed at diverting mentallly ill defendants from the jail:In the past few days, the county launched its managed assigned counsel program for indigent defendants to focus on representing defendants with mental health issues. That's a striking notion: The judiciary, mostly through crimnal courts, raised $185 million more in revenue than its entire appropriation last biennium, but instead of using that extra revenue to pay lawyers for defendants who can't afford them, they tacked on even more fees and still under-funded indigent defense! The previously appointed lawyers for all three defendants recently quit the Orleans Parish Indigent Defender Program after its newly appointed board decided to no longer allow its lawyers to have private practices on the side. [read post]
