In the lead count of the complaint, Aetna asserted that LabCorp made “false and misleading statements” in violation of the Lanham Act, and argued that the false statements were part of an “ongoing and continuous” campaign causing “competitive harm,” including harm to “Aetna’s reputation and competitive business model.
