In my book, The Measure of Injury: Race, Gender and Tort Law (NYU Press 2010), my co-author Martha Chamallas and I talk about how in cases where an individual lacks an earnings history (for example a child) and suffers an injury that will affect future earnings, experts and courts still use race-based and gender-based earnings tables to project earnings into the future.
