Yesterday I mentioned that McLennan County is lurching toward building a private local jail in Waco in the face of strident opposition, and now I find news of a group in Nacogdoches gearing up to oppose a private prison there that's also backed by local leadership. [read post]

They should start by implementing HB 2391, the only legislation passed in 2007 by the 80th Texas Legislature aimed at reducing jail overcrowding.In both Harris and Smith counties, the Sheriffs and local PDs refused to allow their officers to use new discretion created this year by the Legislature to issue a summons instead of making an arrest for certain low-level, nonviolent offenses. True, many jails are full (pdf), but as in Nacogdoches County, I believe overincarceration in Texas stems largely from decisions by elected officials, not raw demographics beyond their control.Bottom line: Texas pols can either support more jail building or they can support keeping taxes low.
