In April of 2014, by a vote of 4-3, with Second District Court of Appeals Judge Jeffrey Froehlich sitting for Chief Justice O’Connor (who was Summit County Prosecutor at the time) the Supreme Court of Ohio allowed Prade to remain free while his lawyers prepared papers asking the high court to reverse the Court of Appeals decision.
