Cuando veo sentencias así, me maravilla el esfuerzo por cuadrar el círculo, pero más me sorprende que estas cuestiones no sea el propio legislador procesal, el que las remedie con norma legal (tan vivo en aprobar leyes para cosas tan perentorias, como por ejemplo, las costas en lo contencioso), en vez de dejarlo a esforzados remiendos judiciales, que como tales, no serán los últimos.
