Last week’s declaratory ruling came in response to questions referred to the FCC by two federal courts in two separate TCPA-based lawsuits.In one suit, filed against EchoStar Satellite LLC in  an Ohio federal court in 2007, a consumer alleged that telemarketers selling subscriptions to EchoStar’s satellite TV service — now provided by the DISH Network — made 30 calls to the plaintiff in violation of the TCPA.
