Louisville and Nashville Railroad Co., the Supreme Court concluded that the power conferred by the RLA on unions functioning as exclusive bargaining representatives was a “power not unlike that of a legislature” and that if the statute permitted the power be used on the basis of “hostile discrimination,” constitutional questions would arise.
