Ryan Holte has argued this is wrong, by the way, that eBay should be cited "for what it held" — i.e. apply the equitable factors, don't presume injunctions are warranted in all cases— not for what Kennedy said in dicta about non-practicing entities.Varadarajan, I think, would agree that viewing eBay as all about the trolls is narrow-minded, especially outside patent law.
