A welcome move away from the reasoning in Stocker v Stocker, in which the High Court and Court of Appeal held (before being overturned by the Supreme Court) that a woman had defamed her ex-husband in saying he tried to strangle her when it “was beyond dispute” that he had grasped her by the throat so tightly as to leave red marks on her neck visible to police officers two hours later.
