He must have been given the assignment either by Chief Justice Roberts or by Justice Thomas; because there are only three Justices - Gorsuch, Kavanaugh, and Barrett - who are junior to Alito, Alito can never be the senior Justice in any majority, and therefore he is never in the position where he can assign a majority opinion to himself.
