For the proposition that "in mass tort litigation, courts have certified issue classes on particular liability elements," the notes cite only pre-Ortiz/Amchem cases, while omitting the much larger body of post-Ortiz/Amchem law (not to mention prior law to the same effect) that almost uniformly rejects class certification in mass tort litigation.
