The research conducted by Lowenstein, reveals the following disparities between predominately black v. predominately white nursing homes: Each of the three predominantly black facilities received the lowest possible rating in 2009 from Nursing Home Compare, a federal database to evaluate nursing homes that are Medicare- and Medicaid-certified. Hoffman-La Roche, Inc., 917 A.2d 767 (N.J. 2007), reversed another case (relied upon by the Appellate Division), finding it improper to apply New Jersey product liability (not consumer fraud) standards nationwide.While we correctly predicted the result, we were dead wrong about the rationale the supreme court chose to get there.
