Justice Moreno contends that permitting imposition of the death penalty in such cases -- at least as applied by the California Supreme Court -- doesn't appear to constitutionally (or rationally) distinguish between those individuals who deserve the death penalty and those who do not. [read post]

But I'll share it anyway: I'm somewhat internally more reluctant to believe guilt in closely-disputed cases when the sentence is (essentially) life in prison as opposed to, say, a decade. [read post]

But I should hope that we would all agree that a system (here, the County of Fresno's) that tells a criminal defense lawyer "You'll be paid a flat $80,000 to do a death penalty case, and that rate includes all expenses (e.g., for investigation and experts)" creates an unacceptably high risk that counsel might skimp on experts and investigation since, after all, that money essentially comes out of his or her own pocket.Someone's life is at stake. Even when, as here, there's no "special" reason to pick out any one particular case in order to do so, and even when there's no seeming time pressure to address those topics that have lingered for almost a century and would happily do so for another if left alone.I like it. [read post]
