That Jack Balkin's parody strikes a nerve is clear when one considers that the discussion about this matter is in fact being seriously debated elsewhere (see Legal Theory Blog).Update 2: Of course, in his own way, Balkin is also an originalist himself, although one who subscribes to a somewhat different doctrine.
