Given the near-universal use of spam filters by providers, the Court agrees with the weight of authority that, generally speaking, a "content provider or user could easily conclude that spam emails are 'harassing' within the meaning of the Act or are similar enough to harassment as to fall within the catchall 'otherwise objectionable.'" The fact that the RNC sent emails to individuals who requested them at some point in time does not undermine this conclusion. [read post]
