The criminal trial of Shirley Cunningham Jr. and William Gallion ended in a hung jury and they are scheduled to be retried in federal court in February.The two filed motions with the Kentucky Supreme Court requesting voluntary withdrawal from the Kentucky Bar as permanent disbarrment. [read post]

Today Andrew Wolfson of the Louisville Courier Journal reports, in a lengthy story:Lexington lawyers William Gallion and Shirley Cunningham Jr., who are charged with bilking clients out of tens of millions of dollars in Kentucky's fen-phen case, were permanently disbarred from practice yesterday by the Kentucky Supreme Court. In what is one more sad, sordid story involving the misconduct of trial lawyers in handling a large settlement, it was announced this week that the three defendant attorneys, Melbourne Mills, Shirley Cunningham, Jr. and William Gallion got some partially good news in that Mills was acquitted in federal court of the counts against him and that Gallion and Cunningham are heading back to trial after the jury deadlocked on their cases.
