The first is Gutierrez, No. 06-5005/AR, a case in which The Judge Advocate General of the Army certified the rather unhelpfully worded issue of "Whether the United States Army Court of Criminal Appeals erred in holding that the trial defense counsel did not affirmatively waive an affirmative defense instruction with respect to a lesser-included offense.
