Where a class of potential claimants is excluded from those rights, the court is entitled to inquire into the reasons for the exclusion, and ask whether it serves any legitimate purpose, or leads to results “so anomalous as to render the legislation unacceptable” (J A Pye (Oxford) Ltd v UK (2008) 46 EHRR 45, para 83).There was no clear basis for the 3 year limit in the contemporary material.
