The trial court indicated that it would order some reimbursement to defendants for their fees and costs because the trial court believed that it was prejudicial to defendants to have incurred the costs of the deposition shortly before the previously scheduled trial, only to have plaintiff change attorneys, continue the trial, and then ultimately decide to forego the evidence deposition.
