I think it is perfectly appropriate for the Wiretap Act to prohibit eavesdropping on someone’s email or web surfing traffic, even if it is technically simple to do so, and even if the eavesdropper has good intentions, for the same reason it is illegal to use a boom mic to listen in on what two people are quietly discussing in a secluded area of a public park.
