A few days ago the Corte di Appello di Roma (Rome Court of Appeal) substantially confirmed the decision at first instance (TMT Enterprises LLC Break Media v Reti Televisive Italiane SpA, sentenza 2833/2017, RG 4046/2016, also commented on Marchi & Brevetti).The decision of the Court of Appeal is arguably VERY good news for rightholders, but also raises a number of questions regarding the overall take on the system of the E-Commerce Directive.
