Well, back in 1999, President Clinton ordered, among other things, that federal agencies should: (1) "closely examine the constitutional and statutory authority supporting any action that would limit the policymaking discretion of the States," (2) "carefully assess the necessity for such action," and (3) "[t]o the extent practicable" "consult[]" with "State and local officials . . . before any such action is implemented.
