I’ve no doubt that what seems clear to me as a criminal defense attorney — that the courts are either accidentally, or deliberately, intellectually dishonest when it comes to the application of these standards in criminal cases; that the “meanings” of these phrases obviously changes depending upon whose ox will be gored.
