Sounds awfully close to an argument that the company, qua company, can never commit a fraud because it can never have specific intent.That certainly turned out to be the Achilles heel of the prosecution of the Arthur Andersen accounting firm in the wake of the Enron scandal.I actually think there may be something to this argument and it is part (not all) of the problem I see with imposing criminal liability on entities like corporations.
