There is no “Congress won’t act, so the president’s power is expanded” clause of the Constitution, and I’m willing to bet that almost no one making this argument made a similar argument during any of the last three Republican administrations, nor would they make it in a Bush III, Rubio or Cruz administration if a future Republican president found his policies blocked by Congress.
